These Terms and Conditions (“Terms”) govern your access to and use of www.deardigitaltree.com, the Dear DigitalTree learning platform, and related services (collectively, the “Platform”) operated by Dear DigitalTree Private Limited (“Company”, “we”, “us”, or “our”).

By visiting the Platform, creating an account, purchasing a course or learning package, downloading an ebook, joining the referral / affiliate programme, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use the Platform.

Please also read our Privacy Policy. Affiliates and referrers must additionally follow the Affiliate Code of Conduct.

1. About the Company

Dear DigitalTree Private Limited is an Indian company registered under the Companies Act, 2013. We provide practical digital education and skill-development programmes for students, homemakers, working professionals, and entrepreneurs across India.

2. Eligibility

You must be at least 18 years of age to create an account, complete a purchase, or participate in the referral / affiliate programme and payouts. By using the Platform you confirm that the information you provide is accurate and that you have the legal capacity to enter into this agreement.

A parent or legal guardian may purchase learning access for a minor. The registered account holder remains fully responsible for all activity on the account and for compliance with these Terms.

3. Accounts and security

When you register (including via email, mobile, or Google sign-in), you must provide complete and current information. You are responsible for safeguarding your password and for all activity under your account.

  • Do not share login credentials or allow others to use your account.
  • Course and package access is linked to a single registered user. Multiple or fake accounts are not allowed.
  • We may limit concurrent device sessions and detect account sharing or concurrent playback. Violation may lead to a warning, session logout, suspension, or permanent termination without refund.
  • Notify us immediately at Support@deardigitaltree.com if you suspect unauthorised access.

4. Our services

Depending on what you purchase or enrol in, the Platform may include:

  • Online courses, video lessons, quizzes, and learning resources
  • Course bundles / learning packages and upgrade offers
  • Ebooks and downloadable study material
  • Completion certificates (where offered for a course)
  • Student dashboard, community features, events or workshops, and support
  • Referral / affiliate tools, KYC verification, and commission payouts

We may add, modify, or discontinue features, content, or delivery formats to keep the Platform relevant and operational. Such changes do not entitle you to a refund unless required by applicable law.

5. Course and package access

Courses, bundles, and related materials are licensed to you solely for individual, personal, educational use. You may not copy, record, redistribute, resell, publicly share, or commercially exploit any content, in part or in full.

Unless a specific product states otherwise at the time of purchase:

  • Course fees and access terms may be revised from time to time based on operational or regulatory requirements.
  • Content, structure, or resources may be updated without creating a right to refund or extra compensation.

6. Payments, pricing, and invoices

Prices are displayed on the Platform in Indian Rupees unless stated otherwise and may include applicable taxes as shown at checkout. Payment is processed through the secure payment gateways we enable at checkout. You authorise us and our payment partners to charge the selected method for the order total.

An order is confirmed only after successful payment. We may issue an invoice or payment receipt through your student dashboard. Coupons, discounts, and promotional offers are subject to their own rules, may be withdrawn at any time, and cannot be combined unless we expressly allow it.

7. Refund and cancellation policy

Digital learning content is made available immediately after a successful payment. For this reason, amounts paid towards courses, learning packages, ebooks, and upgrades are ordinarily non-refundable and non-transferable.

If you believe a payment was completed unintentionally, please write to us at Support@deardigitaltree.com within twenty-four (24) hours of the transaction, along with your order or payment reference. Where we are reasonably able to confirm that the purchase was made in error, we will arrange a refund. Requests received after this 24-hour window cannot be considered, including where you later change your mind, do not use the content, or are dissatisfied with your learning progress.

A refund required under applicable Indian law, or a written confirmation by us (for example, a verified duplicate payment), will still be honoured. If access is suspended or terminated for violation of these Terms, no refund will be due.

8. Intellectual property

All trademarks, logos, course videos, notes, ebooks, graphics, software, and other materials on the Platform remain the property of Dear DigitalTree Private Limited or its licensors. Enrolment grants you a limited, non-exclusive, non-transferable, revocable licence to access the purchased content for personal learning only.

You may not download (except where we provide a download), screen-record, clone, or republish our content without prior written permission.

9. User conduct

You agree not to:

  • Harass, abuse, or discriminate against other learners, instructors, affiliates, or staff
  • Post false, defamatory, or misleading content about the Company, its leadership, products, or community
  • Attempt to hack, scrape, reverse engineer, or disrupt the Platform
  • Upload malware or unauthorised advertising
  • Use the Platform for any unlawful purpose

We may remove content, restrict features, or terminate accounts that violate this section.

10. Certificates

Where a course offers a certificate, it is a skill / participation certificate issued by Dear DigitalTree Private Limited. It is not a university degree, government-recognised diploma, or employment guarantee. Certificates may be issued only after you complete the required lessons or assessments and, where asked, confirm a completion declaration. We may withhold or revoke a certificate obtained through misrepresentation or account sharing.

11. Referral and affiliate programme

Registered users may share referral links or codes for courses and packages. Commissions, if any, are calculated as per the plan and settings published in your dashboard at the time of a successful referred purchase. Earnings depend on individual effort, skill, and market conditions. The Company does not guarantee any income or financial success.

Additional rules include:

  • You must follow the Affiliate Code of Conduct at all times.
  • False income claims, team poaching, fake accounts, and misuse of another person’s referral code are prohibited.
  • Payouts require completed KYC and a valid PAN, and are subject to TDS and other statutory deductions under Indian tax law.
  • Minimum payout thresholds, payout cycles, and processing timelines are as shown in your payout summary and may change.
  • We may withhold, adjust, or forfeit commissions in cases of refund (if any), fraud, chargeback, policy violation, or terminated accounts.

12. Instructors and third-party contributors

Some courses are taught by independent instructors or mentors. Views expressed by instructors are their own. If you apply to become an instructor, additional onboarding terms apply. The Company is not responsible for employment, freelance, or business outcomes you may pursue after learning.

13. Third-party links and tools

The Platform may contain links to third-party websites, payment processors, analytics, social networks, or communication tools. Those services are not owned or controlled by us. We are not responsible for their content, privacy practices, or availability. Please review their terms and policies separately.

14. Disclaimers and limitation of liability

The Platform and all courses, packages, ebooks, and materials are provided on an “as is” and “as available” basis. We do not warrant that learning will result in a job, business, or specific income. We do not warrant uninterrupted or error-free access, though we take reasonable steps to keep the Platform available.

To the maximum extent permitted by Indian law, Dear DigitalTree Private Limited and its directors, officers, and employees shall not be liable for any indirect, incidental, special, or consequential loss, including loss of profit, data, or goodwill, arising from your use of the Platform. Our total liability for any claim relating to a paid purchase shall not exceed the amount you actually paid to us for that purchase.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Termination

You may stop using the Platform at any time. We may suspend or terminate access immediately, without prior notice, if you breach these Terms, the Affiliate Code of Conduct, or applicable law, or if we are required to do so for legal, security, or operational reasons.

Upon termination, your right to use the Platform ceases. Provisions that by nature should survive (including intellectual property, refunds, disclaimers, indemnity, and limitation of liability) will continue to apply.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the Platform after an update constitutes acceptance of the revised Terms. Material changes may also be notified by email or a notice on the Platform.

17. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable consumer-protection rights, courts at Bhopal, Madhya Pradesh, shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the Platform.
